1. Introduction
These Terms, Shipping & Returns apply to all purchases made through the Mindful Labz website (mindfullabz.com.au). By placing an order, you agree to these terms.
Our products are formulated supplementary sports foods and are not suitable for persons under 15 years of age. By placing an order, you confirm you are at least 15 years old. We may cancel orders if we reasonably believe you do not meet this requirement.
Mindful Labz Pty Ltd (ABN: 44 690 784 644) is the seller.
2. Intellectual Property & External Content
All content on the site is owned by Mindful Labz Pty Ltd and may not be copied without permission. We are not responsible for the content, accuracy, or reliability of external sites linked from our website.
3. Products, Pricing & Payments
All products are sold in Australian dollars (AUD). Prices displayed on the website are correct at the time of publication, but may change without notice. Discount codes may be offered at our discretion, and may be withdrawn or limited at any time unless otherwise stated.
Payment is processed by Squarespace Payments.
If payment is declined or suspected fraud occurs, we may cancel your order.
4. Customer Accounts
Customers may create an account. Accounts are managed through Squarespace and passwords are securely stored by Squarespace.
Customers are responsible for choosing secure passwords and keeping login details secure.
5. Order Acceptance
Orders are accepted when we send an order confirmation email.
We may cancel orders at our discretion (e.g. if pricing errors occur or if products become unavailable).
6. Pre-Orders
Some products may be available for pre-order. Payment for pre-orders is taken immediately at checkout. Estimated dispatch dates are provided as a guide only and are not guaranteed. Customers may cancel pre-orders for a full refund at any time before dispatch by emailing support@mindfullabz.com.au.
If material delays occur, customers will be notified via email. If we are unable to dispatch pre-ordered products within a reasonable time, customers may cancel their pre-orders for a full refund.
7. Shipping
We currently ship to Australian addresses only. Shipping fees are calculated at checkout. For products available for pre-order, shipping may be charged per item during the pre-order period.
Any delivery timeframes given are estimates only and may vary due to factors outside our control (e.g. carrier delays, weather, peak periods). Where possible, tracking codes will be provided for courier-delivered orders.
Customers must provide a correct delivery address - we are not responsible for goods delivered to an incorrect address provided by the customer. Risk passes to the customer upon delivery of goods - customers are responsible for goods once the carrier records delivery or leaves the goods at the address provided during checkout.
8. Returns & Refunds
We do not offer returns or refunds for change of mind. Refunds are not available for opened or used products unless required by law.
If your product is faulty, damaged, or incorrect, you may be entitled to a refund or replacement under the Australian Consumer Law. Please contact support@mindfullabz.com.au within 7 days if you believe your order qualifies for a refund or replacement under these conditions, and include the product, batch number, and photos of the fault. If a return is accepted under these terms or the Australian Consumer Law, we will provide instructions and may cover return shipping at our discretion.
9. Liability
To the extent permitted by law, Mindful Labz Pty Ltd excludes all liability for loss or damage arising from the use of our products, including indirect or consequential loss. We are not liable for delays or failures caused by events outside our control, including carrier delays, weather, or industrial action.
Nothing in these Terms limits customers’ rights under the Australian Consumer Law.
10. Severability & Entire Agreement
If any part of these terms is invalid, the rest remains in effect. These terms are the entire agreement between you and Mindful Labz Pty Ltd.
These terms are governed by the laws of Queensland, Australia.
11. Changes to Terms & Conditions
We may update these terms at our discretion without warning. The latest version of these terms will always be available on our website.
